Edmonds Marshall McMahon, on behalf of Provident Personal Credit Limited, brought a successful private prosecution against the Defendant, Danielle Kane, for two offences of fraud by abuse of position and two offences of fraud by false representation contrary to s.1 of the Fraud Act 2006 and one offence of theft contrary to s.1 of the Theft Act 1968.
There was clear evidence that the Defendant had committed the offences of fraud by abuse of position and fraud by false representation by falsifying and submitting fraudulent loan agreements to Provident in an effort to justify her conduct. Furthermore, there was evidence that she had also stolen monies collected from Provident customers that should have been paid to Provident.
On the 5th October 2016, Ms Kane appeared at the Hartlepool Magistrates’ Court, where she pleaded guilty to all charges. She was sentenced to six months’ custody suspended for 12 months and payment of compensation in the sum of £5,814 as well as a victim surcharge.
