Commercial Disputes

EMM handle a wide range of domestic and international dispute work.

Our cases are invariably complex and sensitive in nature and frequently involve:

  • Company shareholder and investor disputes
  • Claims against directors for breach of fiduciary and contractual duties
  • Partnership and joint venture disputes
  • Disputes with banks and other financial institutions
  • High value employment disputes involving the misuse of confidential information and breach of restrictive covenants
  • Bankruptcy and insolvency disputes
  • Professional negligence claims against lawyers, accountants, architects and other professional advisors
  • International arbitrations before the LCIA and ICC

Many of our disputes are multi-jurisdictional in nature and involve applications for urgent interim relief, including worldwide “freezing injunctions” and applications and “Norwich Pharmacal” and “Bankers Trust” orders.

We act both for and against individuals and companies. We even act for nation states.  And because we only handle dispute-related work, we are genuinely “conflict-free”, meaning that we can bring litigation against the largest of companies, banks and other financial institutions without fear or favour.

We aim to provide an exceptional, partner-led, service with an emphasis on a rigour attention to detail, careful strategic thinking, and engineering the best possible outcomes for our clients at the earliest possible opportunity.

We are experts in mediation and other forms of alternative dispute resolution (“ADR”).

Examples of our dispute work include:

  • Acting for an international finance house in claims against a South American client for the recovery of sums due under an international supply contract.
  • Acting for a client in High Court professional negligence proceedings against her former solicitors arising out of their mishandling of a civil fraud claim.
  • Acting for a shareholder/director of a multimillion pound family business in claims against directors and family members for breaches of fiduciary duty, misrepresentation and the misappropriation of business assets.
  • Acting for a US company in a shareholder dispute arising out of the ownership of a Zambian iron foundry with related proceedings in Mauritius and the UAE.
  • Acting for an Estate in respect of a professional negligence claim against a law firm that assisted with the transfer of over £3m worth of assets to a Swiss trust by an investment adviser who had defrauded his principal.
  • Pursuing a professional negligence claim against the former solicitors of a victim of a substantial crypto-fraud who suffered losses arising out of the law firm’s alleged failure to correctly interpret blockchain evidence and target the correct defendants.
  • Acting for a group of overseas and UK clients who were each defrauded of millions of pounds by a UK-based FX trader and an FCA-regulated currency dealer.
