Following a successful private prosecution, Mr James Boulton, was sentenced to an immediate custodial sentence of 32 months following a sustained and lucrative fraud, in breach of trust, on Summit Aviation Limited and Gloucester Jet Test Centre Limited.
Over a period of at least 12-years, between 2012 and 2023, Mr Boulton abused his senior position and systematically defrauded the two companies of at least £233,745.99.
Mr Boulton used a combination of his seniority and autonomy within the business, and hundreds of forged documents, to justify and cover up a substantial number of transactions that transpired to be payments for items entirely for personal use. Examples of some of Mr Boulton’s personal expenditure using the companies’ money include; a family trip to Athens, 10 iPhones, 3 iPads, 4 laptops, golfing equipment, a sofa, watches and fence panels.
In 2023, an accounts manager began investigating her suspicions that Mr Boulton was using company money for personal use. This ultimately led to a full investigation and the matter was reported to Action Fraud and the Police. Unfortunately, the matter was not pursued by either.
In April 2024, Julie Wing, Shareholder and Director of the companies, instructed Edmonds Marshall McMahon (“EMM”). EMM made a second report to Action Fraud in the same month who responded that it had “not been possible to identify a line of enquiry which a law enforcement organisation in the United Kingdom could pursue”.
In the face of inertia, a criminal investigation led to the complex fraud being uncovered and a criminal private prosecution commenced, leading to a guilty plea by October 2024.
On 21 October 2025, HHJ Smith, sitting at Maidstone Crown Courtsentenced Mr Boulton and remarked that Mr Boulton’s “Persistent dishonesty didn’t just have a financial impact. It also an impact on employees – to an extent you put their position in peril.” Mr Boulton had worked with these employees for many years.

“I am very saddened by today’s events. This situation brings me no pleasure. The entire episode has caused great pain not only to me, but also to many members of staff who have worked with and known James Boulton for many years. He was regarded as not just a trusted and loyal member of Summit Aviation for over 30 years, but he was the Chair of school governors for a local school and his honesty was never questioned.
We gave Mr. Boulton several opportunities to put things right, but he failed to do so and continued to deny any wrongdoing. We were therefore left with no choice. This was not a decision we took lightly, but it was the right and necessary course of action”.
Ashley Fairbrother (Partner at EMM), who led the prosecution, together with Mike Jackson and Monique Iginla, comments:
“Mr Boulton carried out a sustained and calculated fraud over more than a decade, abusing the senior position of trust he held within the company. He controlled the accounting systems and abused that access to defraud his employer, and thereby his colleagues and friends, of over £230,000, through hundreds of fabricated invoices, refunds and personal purchases disguised as legitimate company expenditure.
This was not an isolated mistake but a systematic course of dishonesty spanning 12 years. Even when challenged, he was hostile and unrepentant, and made deliberate efforts to destroy evidence. Despite the ability to do so, he has not yet repaid the full amount of the money he stole.
The message must go out to those who believe long-standing and trusted businesses are easy targets – they are not. These offences are serious, and the consequences are serious. The time, effort and loyalty invested in building this company over many years was betrayed, and this sentence reflects the gravity of that breach of trust.”
