Kate McMahon has recently been published in a piece in the Accountant Online titled ‘Why choose to privately prosecute?

In the article Kate discusses the ability to privately prosecute, who can bring a private prosecution and the circumstances leading to it being an increasingly popular and effective tool.

She goes on to discuss the recent prosecution of Elie Taktouk explaining how the investigation revealed a £2.5m fraud on the victims Frank and Adrien Noel.

Finally, she explains the ability for private prosecutors to recover the amounts stolen from them through the Confiscation and Compensation provisions with reference to two other cases in which EMM conducted the investigation, prosecution and subsequent Confiscation proceedings; R v Asplin & others and R v Lawless.
