Edmonds Marshall McMahon, on behalf of Provident Personal Credit Limited, brought a successful private prosecution against the Defendant, Clare Gibbs, for twenty-five offences of fraud by abuse of position contrary to s.1 of the Fraud Act 2006.
There was clear evidence that the Defendant routinely committed the offence of fraud by abuse of position during her employment as a loans agent for Provident by asking others to take out loans for her benefit, retaining customers’ monies, not accounting to Provident for monies that she had received and submitting loan agreements to Provident that she knew were not bone fide.
On the 30th September 2016, Ms Gibbs appeared at the Canterbury Crown Court, where she pleaded guilty to all charges. She was sentenced to two years imprisonment suspended for eighteen months on each count to run concurrently with an unpaid work requirement of 200 hours and £10,000.00 compensation.
