TM Eye v Katie Devlin

Edmonds Marshall McMahon, on behalf of TM EYE Ltd, brought a successful private prosecution against the Defendant, Katie Devlin, for five offences of selling counterfeit products which infringed trademarks owned by Pandora A/S and Louis Vuitton Malletier contrary to s. 92 of the Trademark Act.

There was clear evidence that the Defendant sold counterfeit goods to undercover operatives which infringed trademarks owned by Pandora A/S and Louis Vuitton Malletier. Furthermore, the Defendant had been observed actively engaged in the possession and sale/offering for sale of counterfeit goods in the course of business.

On the 6th of November 2015, Ms Devlin appeared at the Thames Magistrates’ Court, where she pleaded guilty to all the charges. She was sentenced to a £120 fine, £20 victim surcharge and £180 court charge.
