TM EYE v Nasir Mustafa

Edmonds Marshall McMahon, on behalf of TM EYE Ltd, brought a successful private prosecution against the Defendant, Nasir Mustafa, for 15 offences of selling counterfeit DVDs which infringed trade marks    owned by Universal, Warner Brothers and 20th Century Fox, contrary to s.92 of the Trade Marks Act 1994.

There was clear evidence that the Defendant, Mr Mustafa, sold counterfeit goods to undercover operatives which infringed trademarks owned by various universal companies. Furthermore, the defendant had been observed actively engaged in the possession and sale/offering for sale of counterfeit goods in the course of business.

On the 15th October 2015, Mr Mustafa appeared at the Thames Magistrates Court, where he pleaded guilty to all 15 charges. He was sentenced to a community order for 12 months with 180 hours unpaid work.  He was also ordered to pay the £60 victim surcharge and £180 court charge.
