As you may know, the majority of prosecutions in England and Wales are conducted by public agencies, including the Crown Prosecution Service (“CPS”) and Serious Fraud Office (“SFO”). However, the right of to pursue a private prosecution is expressly preserved by section 6(1) of the Prosecution of Offences Act 1985 – under this section, any person or entity that has “legal personality” has the right to bring a prosecution. It is this statutory power which Edmonds Marshall McMahon relies on to advise and represent its clients.

The founding partners have extensive experience in the area of regulatory law, having advised and prosecuted for the Medicines and Healthcare Products Regulatory Agency (“MHRA”), the Department for Food, Environment and Rural Affairs, the Health and Safety Executive and the Environment Agency. A combined total of 16 years’ experience prosecuting on behalf of and providing advice to the MHRA means there is little we do not know about this complex regime. The background of our partners and senior lawyers allows us to give comprehensive, commercial and effective advice – whether that be for the regulator or for those subject to the regulatory regime.
