TM Eye v Widi Chen

Edmonds Marshall McMahon, on behalf of TM EYE Ltd, brought a successful private prosecution against the Defendant, Widi Chen, for nine offences of selling counterfeit products which infringed trademarks owned by Louis Vuitton Malletier and Mulberry Company Design Limited contrary to s. 92 of the Trademark Act.

There was clear evidence that the Defendant sold counterfeit goods to undercover operatives which infringed trademarks owned by Louis Vuitton Malletier and Mulberry Company Design Limited. Furthermore, the Defendant had been observed actively engaged in the possession and sale/offering for sale of counterfeit goods in the course of business.

On the 20th of November 2015, Mr Widi appeared at the Thames Magistrates’ Court, where he pleaded guilty to all the charges. He was sentenced to pay a £900 fine, £30 victim surcharge and £110 court charge.
